Key takeaway

Off-market homes in Beverly Hills are sold without public advertising, and since 2025 a seller who wants privacy files one in the MLS as an office exclusive or a delayed-marketing listing that the public can't see. You reach them through an agent who asks inside a brokerage and broker to broker, which NAR's rules allow, so the search is only as good as the brief you send. Fill in the form above and your criteria go to the agent this guide features; nothing is shown publicly.

Who this guide is for

You want a Beverly Hills or Westside home that may never appear on a public site and are deciding whether a private search is worth starting, and what to send.

What off-market homes in Beverly Hills are, and why sellers choose them

An off-market home is for sale without photos on public sites, a sign or an open house. The seller trades a wider pool of buyers for privacy, a quiet price test, or the chance to sell before work on the house is done. For you, the trade is fewer competing bidders and less public price evidence.

How much of the top end trades off the MLS

The best count we have is old. Miller Samuel found that in the first quarter of 2017 about 19% of Greater Los Angeles sales weren't on the MLS, and about a third of sales over $5 million were missing from it. We haven't found a current figure, and the 2025 rules below changed how private listings are filed, so treat that share as history, not a forecast.

Recent off-market sales at the top

Several recent top-end sales in the Los Angeles area were reported as off-market, including a $210 million Malibu sale in 2024 reported by Robb Report in January 2025. Our guide to pocket listings covers more of them and how the practice has changed.

The rules for off-market homes since 2025: Clear Cooperation and private listings

The rules decide where a private listing lives and who's allowed to hear about it. They're why a portal search won't find these homes and an agent's phone call can.

Clear Cooperation and the one-business-day rule

NAR kept its Clear Cooperation Policy. Once a listing is marketed publicly, it must be filed with the MLS within one business day. CRMLS, California's largest MLS, applies the same rule and draws the line at the brokerage: marketing inside it is private, and marketing outside it is public.

Office exclusives and delayed marketing

NAR's Multiple Listing Options for Sellers policy took effect on March 25, 2025, and MLSs had to adopt it by September 30, 2025. It lets a seller choose an office exclusive, which is filed with the MLS but hidden from other members and kept out of public marketing, or a delayed-marketing listing, which holds back IDX and syndication for the period the local MLS allows. Both need the seller's signed consent.

What one-to-one broker talks allow

NAR says one-to-one conversations between two brokers about a listing don't trigger Clear Cooperation. Communications across several brokerages do count as public marketing. That's the narrow channel a private search uses: your agent can ask a listing broker directly whether a seller would meet a buyer like you.

How a private search for off-market homes works through the featured agent

The form above sends your criteria to the agent this guide features, profiled on the featured agent page. Here's what happens next, and what doesn't.

Step 1: your brief is read and checked

The agent reads your criteria and may call to tighten them. A brief that names a price band, the city, the lot and a timeline can be raised with a listing broker in a sentence. A brief that says "something special in 90210" can't.

Step 2: inside the brokerage, then broker to broker

Office exclusives in the agent's own brokerage can be shared with you directly. Beyond it, the agent asks listing brokers one at a time, the channel NAR's rules allow. Nobody can promise you a match, and we don't publish inventory.

Step 3: the introduction and the agreement

If a seller agrees to show, you'll be asked to sign a written buyer agreement before touring, as with any purchase since August 17, 2024. Read the fee and the term first. Expect the listing side to ask for proof of funds or a jumbo pre-approval before an address is shared. Our guide to buying in Beverly Hills covers that paperwork.

What to send so the search for off-market homes is useful

Six facts turn a wish into a brief a listing broker can answer yes or no to. Put them in the form's notes.

Criteria that narrow the search

  1. Price band, with a ceiling you'd really pay.
  2. City: Beverly Hills only, Los Angeles enclaves only, or either. The line changes your taxes and the school district.
  3. Lot: flat or hillside, minimum size, and whether you'd build or renovate.
  4. House: bedrooms, a minimum size, and any must-have such as a guest house or a view.

Proof you can close

  1. Funds: cash, or a jumbo loan with a pre-approval. Every loan over $1,249,125 on a one-unit Los Angeles County home is jumbo in 2026, and our jumbo loans for off-market purchases explains the terms.
  2. Timing: when you can tour and how fast you could close.

Named enclaves help too. If you want Trousdale Estates or Bel Air and nowhere else, say so. A broker can answer a named place faster than a ZIP code.

Here's a brief you can copy and change: "$12 million to $15 million, cash. City of Beverly Hills only, north of Sunset. Level pad of at least 20,000 square feet, open to a rebuild. Five bedrooms or more. Can tour within two weeks and close in 30 days." Every line rules homes in or out. If you'd pay the Los Angeles side's transfer tax for the right lot, say that too, because it widens the area a broker can search.

The catch with buying off-market homes in Beverly Hills

Fewer bidders can mean a better price. It can also mean less evidence that the price is fair, and you carry that risk.

Less price evidence

A private sale has no public days on market and no public price cuts to read. Ask for every recorded sale on the street and in the same city for the last 12 months, and adjust anything across the city line for transfer tax. The Beverly Hills homes for sale guide sets out prices by area.

The same taxes and the same checks

Off-market doesn't mean off the books. A sale in the City of Los Angeles still pays the city transfer tax and Measure ULA: 5.95% combined on a sale of $10.9 million or more after June 30, 2026, or $773,500 on a $13 million house. The transfer tax calculator shows any price. Inspections, title review and permit checks matter as much as in an open sale, and a seller who skipped the open market may have skipped pre-listing reports too. Ask for them, and confirm tax questions with a CPA.

When the open market is the better search

If your criteria are broad, or you're early in your search, public listings will show you more homes faster. A private search earns its keep when you know the street, the lot and the price, and the right house simply isn't listed. Owners on the other side of that trade can read our guide for Beverly Hills sellers.

Off-market homes in Beverly Hills FAQs

How do I find off-market homes in Beverly Hills?

You can't search for them on public sites, because sellers have chosen to keep them off. An agent finds them by checking office exclusives inside their own brokerage and asking listing brokers one to one, which NAR's rules allow. A precise written brief with price, city, lot and timing makes those questions answerable.

Are pocket listings legal in California?

Private listings are allowed, within MLS rules. Under NAR's Clear Cooperation Policy a listing must go into the MLS within one business day of public marketing. Since 2025, a seller can choose an office exclusive or a delayed-marketing listing instead, each with a signed disclosure giving informed consent.

What is an office exclusive listing?

An office exclusive is a listing the seller keeps off the MLS feed and out of public marketing. Under NAR's 2025 policy it's still filed with the MLS but isn't shown to other participants, and the seller must sign a disclosure. Agents in the listing brokerage can share it with their own buyers.

Do off-market homes in Beverly Hills sell for less?

There's no current published figure that says so. A private sale has fewer bidders, which can help a buyer, but also less public price evidence. Check every recorded sale on the street and in the same city for the past year, and adjust Los Angeles sales for Measure ULA.

Does Measure ULA apply to off-market sales?

Yes, if the property is in the City of Los Angeles. ULA applies to the deed, not the marketing, so Bel Air, Holmby Hills, Beverly Crest and Beverly Park sales pay it either way. For sales after June 30, 2026, the combined city rate is 4.45% above $5.4 million and 5.95% at $10.9 million or more.

What happens after I send the private search form?

Your criteria go to the agent this guide features, who may call to refine them. If a matching home is found, the listing side will usually ask for proof of funds or a pre-approval, and you'll sign a written buyer agreement before touring. Nothing you send is published.
